Oak Grove is a Florida Not-for-Profit Corporation (Homeowner’s Association) and is a Deed Restricted Community. As such, the Florida statutes and Association documents govern Oak Grove and are important part of your understanding as an Oak Grove homeowner and resident. The Statutes and Association Documents are legal and binding documents. Failure by the Association to follow these statutes and documents can result in penalties levied by the Florida Department of State, Division of Corporations. In addition the Department of Business and Professional Regulation, Division of Florida Land Sales, Condominiums and Mobile Homes also handles some aspects of monitoring homeowners associations. The state of Florida as well as case law is very clear in one thing - the Association must abide by and enforce all the provisions of the Statutes and Association Documents. The Association cannot simply pick and choose which parts to follow. In addition to all the documents listed, there are also national acts that affect Oak Grove - The Telecommunications Act, The Energy Act, etc. Association governing statutes:
Florida Statutes 617 and 720 are available on the Florida Legislature website by following the link for Statutes. Keep in mind that the Statutes may change each July 1st. Also, remember that not all the sections of these Statutes will apply to homeowner associations, whereby excluded parts are clearly listed in the Statutes. Please check this link often as new rules are sometimes added or modified. Things you should know about ARCHITECTURAL IMPROVEMENTS Before you make ANY EXTERIOR CHANGE to your house or property (front or back yard), you MUST receive APPROVAL from the Association. Exterior changes to your property may include, but are not limited to: landscaping including curbing and tree placement or replacement; fence installation (professional or self placement); pool, screen room, landscaping, or retention wall installation; painting or repainting your house or fence (even if the color is the same color as it is now); and flag pole or landscaping fountain installation.
