Architectural Control
Committee meetings are held on the second Tuesday of each month at
Ferman Dealership on SR 54. All meetings start at 7pm and adjourn
within 1 hour. Volunteer participation is EASY! It includes
your attendance at the meeting and assisting to uphold the following
responsibilities of the committee:
1. Timely
approve or disapprove architectural requests/plans submitted.
2.
Periodically review the ACC Guidelines.
3. Ensure
timely compliance with approved applications.
4. Hear and
rule on all appeals brought before the ACC and make recommendations to
the Association's Board of Directors of any existing violation.
Instructions for Requesting
Approval

Submit the
appropriate Request form. You may e-mail a copy to the
Architectural Chairperson, fax

IF YOU ARE PAINTING YOUR HOME, even if you are painting the exact
same color as you currently have, you must fill out the
ACC paint
request form and receive
written permission. The Sherwin Williams store located at 2409 Raden
Drive in Land O' Lakes will give Oak Grove residents a 25% off discount
by stating Oak Grove HOA at checkout. For further information, you can contact the

IF YOU
ARE INSTALLING/REPLACING YOUR FENCE, the
ACC fence request
form should be submitted.

FOR ALL OTHER REQUESTS,
The ACC
Request form should be used for landscaping, pool, porch
extensions, new sod or sod replacements, house gutters, flag poles
installations/relocation, landscape board designs, etc.

Submit 2 copies
of your lot survey (per the Covenants) for all outdoor requests
except for house paint and wood fence stain requests. Draw
out plans on one copy of the survey. (Do NOT submit original certified
survey copy)

If a contractor will
do the work, provide a copy of the contractor’s proposal (dollar amounts
are not necessary) with detail plans including drawings, supplies,
colors, textures, etc.)

If the work will be
completed by you, provide a detailed list of all materials, colors,
textures, and drawings; and
·
Submit any photos,
additional drawings with dimensions or sketches of the work to be
performed that you feel may help in the Committee's decision making.
Things
to know about ACC requests:
·
You must receive
written approval from the Architectural Control Committee (ACC)
before any work can be started. This approval assists to ensure you
are not performing improvements which may be in violation of the
Association deed restrictions;
·
The approval
submission items as stated above will not be returned to you. All
submitted documents must be kept as part of the Association records.
Please make any copies necessary for your files prior to submission to
the Association;
·
There are NO verbal
requests or approvals - everything must be in writing and maintained
in your Association file. Letters of approval or denial are mailed
within 10 days of the ACC monthly meeting, provided all required
information is received. If we do not receive the required information,
your request WILL BE RETURNED and you will need to RESUBMIT and wait for
the next month’s meeting. However, the ACC Chairperson will make all
attempts to contact you to obtain timely submission of any information
you did not adequately submit;

No one,
including a Board member or the ACC Chairperson, can make approvals on
his or her own. You must follow the proper procedures and allow the
Architectural Control Committee time to meet, review all paperwork and
make their decision. Exceptions to established processes will NOT be
made even in time crunch instances. Please submit all requests and
documents timely prior to each Committee meeting.

upcoming plans before you make a purchase. We find that your questions
help avoid potential problems of a deed restriction violation.

Oak Grove is a
deed restricted community. Deed restrictions are necessary to
facilitate steady home prices and a uniform community appearance.
Fortunately for Oak Grove, the deed restrictions are minimal and are
voted upon by the community homeowners.
Monthly, the Violations Committee monitors the community for
deed restriction violations (see
Deed Restriction Resolution). Monitoring
involves no more than 1 hour a month from each volunteer. Based on
volunteer monitoring and complaints received and reviewed, the
Violations Chairperson prepares violation letters to
residents for prompt attention of their existing violation(s).
Violations that are unresolved in the predetermined period require a
meeting and decision of the Violations
Remediation Committee.
Recommendations, including
fines, are provided to the board for consideration of an appropriate action
against the violating property.
Violation
letters do not mean that you are a bad homeowner. The Board is
committed to the enforcement of deed restrictions. It is not a job that
any volunteer Board or committee member enjoys, but it is the Board’s
fiduciary responsibility to the Association members. Please
take all necessary actions to correct your violations timely prior to
further action as required by the Association. Further action can
become costly to the violating party (including fines, correction
assessments, and attorney fees) than just
taking the time promptly correct the issue. Keep
in mind that just because an infraction had not been enforced in the
past does not give an Owner the right to violate that restriction. Nor
is the lack of previous enforcement meant as approval from the
Association.
Very important
notes about deed restrictions -Two
instances of case law underline how the Oak Grove Association must act
in the enforcement of deed restrictions:
1) The Association
must enforce ALL deed restrictions, or enforce NO
of the deed restrictions.
2) The Association
deed restrictions must be enforced in a uniform manner.
Association cannot pick and choose which deed restrictions to enforce
and not to enforce. This means, you may receive a violation letter for
something you perceive to be a very small matter while you notice your
neighbor with a larger infraction. Regardless of the degree of the
violation, both will receive a letter if you are not in compliance with
the deed restrictions.
Please
report a deed restriction
violation to the
Violations Committee Chairperson
and include:

House number and street name of the lot in violation;

A detail description of the violation
including location on the lot; and
-
Pictures of the violation (if
possible)
The Violations Chairperson will investigate all reported concerns BEFORE
a letter is mailed.
**Please note that some matters
may NOT be addressable by the Association or Violations Committee if the concern is NOT defined in the HOA deed restrictions or
Association documents. These concerns include: dog barking
at a neighbor's house next door (county noise ordinance); trash piled up
on the side or rear of the neighbors house (county code compliance).
However, the Committee will be happy to assist by contacting the county
where appropriate. If you would like to submit a concern to Pasco
